Welcome to La Cuisine Moderne. These Terms of Service ("Terms") govern your access to and use of our website and your purchase of products from our online store (the "Store"). By visiting our Store or placing an order, you agree to these Terms. Please read them carefully.

1. Who we are

The Store is operated by La Cuisine Moderne ("we", "us", "our"). All prices are listed and charged in Canadian dollars (CAD). We sell and ship within Canada only.

2. Eligibility

To place an order, you must be at least the age of majority in your province or territory of residence (18 or 19 depending on the province) and able to enter into a binding contract. By ordering, you confirm that you meet these requirements.

3. Products, descriptions and pricing

We work to describe and display our products as accurately as possible, including materials, specifications and dimensions. Slight variations in colour or finish may occur due to screen settings and the natural characteristics of stainless steel and carbon steel cookware.

All prices are in CAD and may be subject to applicable federal and provincial sales taxes (GST, HST or PST), which are calculated at checkout based on your shipping address. We reserve the right to correct any pricing or description errors, and to change prices, products and availability at any time before your order is accepted.

4. Orders and payment

When you place an order, you make an offer to purchase. Your order is confirmed once payment is received in full at the time of checkout. We reserve the right to refuse, cancel or limit any order, including where a product is unavailable, where there is a pricing or description error, or where we suspect fraud. If we cancel an order you have already paid for, you will receive a full refund to your original payment method.

5. Shipping

We ship within Canada only. Estimated delivery and related details are set out in our Shipping Policy, which forms part of these Terms.

6. Returns and refunds

Your return and refund rights are set out in our Return and Refund Policy, which forms part of these Terms. Nothing in these Terms removes or limits any rights you have under applicable consumer protection law.

7. Intellectual property

All content on this Store, including text, product descriptions, layout, logos and graphics, is owned by or licensed to La Cuisine Moderne and is protected by applicable law. You may not copy, reproduce or reuse any part of it without our written permission.

8. Acceptable use

You agree not to use the Store for any unlawful purpose, to interfere with its operation or security, or to submit false or fraudulent information. We may suspend or restrict access where these Terms are breached.

9. Warranties and consumer rights

Our products are sold subject to the legal guarantees and warranties provided under the consumer protection laws of your province or territory, which cannot be excluded. Except for those non-excludable rights, and to the fullest extent permitted by law, the Store and its content are provided on an "as is" and "as available" basis.

10. Limitation of liability

To the fullest extent permitted by applicable law, La Cuisine Moderne will not be liable for any indirect, incidental or consequential damages arising from your use of the Store or products. Nothing in these Terms limits liability that cannot be limited under applicable Canadian or provincial law, including your statutory rights as a consumer.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If you are a consumer resident in another province or territory, you continue to benefit from the mandatory consumer protection rules of your home jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. The version posted on this page at the time of your order applies to that order. The "Last updated" date shows when the Terms were last revised.
